Pre-Nuptial Agreements
As their name implies, a pre-nuptial agreement, or “prenup” for short, is a document signed before a couple enters into marriage that helps detail some of the terms of a divorce ahead of time. It is important to note, however, that if the terms of this agreement are not fair to both spouses at the time of the divorce, the agreement will not be honored.
A pre-nuptial agreement can create provisions for divorce issues, including:
- Asset and debt division
- Spousal support
- Child support
Post-Nuptial Agreements
A post-nuptial agreement functions essentially exactly the same way as a pre-nuptial agreement, only instead of being signed before the marriage begins, it is signed after. These are more commonly used in the event that one spouse begins behaving erratically after a marriage begins, such as spending too much money or building up credit card debt after tying the knot.
